Qld Legislation as set out in the Fire and Emergency Service (Domestic Smoke alarms) Legislation Amendment Act 2016 and the Building and Fire Safety (Domestic Smoke Alarms) Legislation Amendment Regulation 2016 requires Queensland landlords to take greater responsibility and ensure they provide a high level of safety in rental properties.

Smoke alarms must be tested and cleaned within 30 days prior to the start of a New Lease or Lease Renewal tenancy

From January 2017

  • Smoke alarms that do not operate when tested must be replaced immediately
  • Existing smoke alarms manufactured more than 10 years ago must be replaced
  • When replacing smoke alarms they must be photoelectric and comply to Australian standard (AS)3786-2014

From January 2022

  • Smoke alarms in all rental dwellings must be Photoelectric Australian Standard (AS)3786-2014
  • Be hard wired or powered by a non-removable 10 year Lithium Battery
  • Be less than 10 years old
  • Operate when tested and be interconnected with every other alarm in the dwelling so they activate together
  • Installed on each storey – every bedroom and hallways connecting to rest of dwelling
  • If there is no hallway be installed between bedrooms and other parts of the storey
  • If there are no bedrooms on a storey at least one smoke alarm in likely path of exit
